These terms are pending legal review by a qualified solicitor. The operator details, minimum-age posture, jurisdiction, venue, and contact address reflect the current operating model, but the text has not yet been formally validated. Treat as advisory until a reviewed version replaces it.
1. Acceptance of these terms
By creating an account or using Second Star (the “Service”) you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
Second Star is an independent trip-planning tool for theme-park visits, operated by Scot n Nerdy Ltd, a company registered in Scotland, trading as Second Star. References in these terms to “Second Star,” “we,” “us,” or “our” mean Scot n Nerdy Ltd.
The Service is not affiliated with, endorsed by, or sponsored by The Walt Disney Company or any of its subsidiaries. All Disney park names, ride names, characters, and trademarks belong to The Walt Disney Company and its affiliates.
We generate suggested daily itineraries using live wait-time data and AI. Itineraries are suggestions, not promises — actual park conditions on the day of your visit may differ from what the Service predicts.
3. Eligibility
You must be at least 18 years old to create an account. Adults may enter the ages of children in their travelling group; the Service does not create or maintain accounts for children.
4. Your account
You are responsible for keeping your sign-in credentials secure. You agree to provide accurate account information and to notify us promptly of any unauthorised use of your account.
We may suspend or terminate your account if you violate these terms, abuse the Service, or attempt to undermine its security or availability.
5. Subscriptions, billing, and cancellation
Second Star offers free use and paid plans. The current paid plans are:
- Monthly subscription, which renews automatically each month.
- Annual subscription, which renews automatically each year.
- Trip pass — a one-time purchase that grants access to paid features for a specific trip.
Payments are processed by Stripe. By subscribing you authorise Stripe to charge your payment method according to the plan you select.
You may cancel a subscription at any time from your account settings. Cancellations take effect at the end of the current billing period — we do not pro-rate refunds for partial billing periods unless required by applicable law.
Trip-pass purchases are non-refundable once the associated trip dates have passed.
6. Free-tier limits
To prevent abuse and keep the Service available to all users, free accounts are subject to:
- Up to four itinerary generations per trip per 24-hour period.
- Up to ten trips per user per 24-hour period.
- Per-endpoint rate limits — approximately ten AI-generation requests per minute and approximately sixty requests per minute on other endpoints.
These limits may change as we tune capacity. Persistent attempts to circumvent the limits may result in account suspension.
7. Acceptable use
You agree not to:
- Reverse engineer the Service or attempt to extract bulk data beyond what your own account legitimately requires.
- Use the Service to harass other users, or to share content that is unlawful, defamatory, or infringing.
- Attempt to bypass authentication, row-level security, or rate limits.
- Resell or sublicense access to the Service without our written consent.
8. AI-generated content
Itineraries are generated by Anthropic’s Claude model and assembled by Second Star using your ride preferences, the composition of your group, any times you have anchored to the day, and live wait-time estimates.
AI-generated content is provided “as is” and we make no warranty about its accuracy, completeness, or suitability for your trip. Wait-time data is sourced from upstream third parties and may be stale or unavailable. Always confirm critical details (operating hours, ride closures, height requirements, reservation times) with the official park sources before relying on a generated itinerary.
9. Your content
You retain ownership of the preferences, anchored plans, and itinerary inputs you provide (“Your Content”). You grant Second Star a limited, worldwide, royalty-free licence to host, process, transmit, display, and adapt Your Content as needed to provide the Service to you.
10. Public share links
When you create a share link for a day or a trip, the recipient can view the itinerary at a public URL without an account. By creating a share, you grant any recipient permission to view the linked content for as long as the share remains active.
You can revoke a share at any time. Open the share dialog within the app and use the Revoke control to deactivate the link immediately, or contact us at privacy@secondstar.app if you cannot reach that control. Once revoked, the link will return a not-found response.
11. Third-party services
The Service relies on third-party providers, including Stripe (payments), Anthropic (AI), Queue-Times (wait-time data), Mapbox (maps), Supabase (data and authentication), Upstash (rate limiting), Sentry (error tracking), and PostHog (analytics). Outages or limitations of these providers may affect the availability or accuracy of the Service.
We are not liable for third-party outages or for changes to third-party services that are outside our reasonable control.
12. Intellectual property
Second Star, the Second Star name, the visual design of the Service, and the software underlying the Service are protected by intellectual-property laws.
Disney trademarks, ride names, characters, and copyrighted imagery that appear in or are referenced by the Service belong to The Walt Disney Company and its affiliates. Nothing in the Service grants you a licence to any third-party intellectual property.
13. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, accurate, or error-free.
14. Limitation of liability
To the maximum extent permitted by law, neither Second Star nor its operators will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising out of or in connection with your use of the Service.
Our total aggregate liability for any claim relating to the Service is limited to the amount you have paid us for the Service in the twelve months preceding the claim. Some jurisdictions do not allow certain liability disclaimers, so portions of this section may not apply to you.
15. Changes to these terms
We may update these terms from time to time. If we make material changes we will update the “Last updated” date and, where required, notify you in product or by email. Continued use of the Service after the effective date of an updated set of terms constitutes acceptance.
16. Termination
You may stop using the Service and request deletion of your account at any time. We may terminate or suspend your access if you materially violate these terms, abuse the Service, or if we discontinue the Service.
17. Governing law
These terms are governed by the laws of Scotland. Disputes arising from these terms will be resolved in the courts of Scotland, except where applicable law requires otherwise.
